Sir:-
I am directed by the Board of Trade to acknowledge
the receipt of your letter of 25th November (No.45341)
with its enclosures, on the subject of the refusal of
the Japanese Patent Bureau to register a certain trade
mark.
In reply, I am to say that while the letter ad-
dressed to the British Cigarette Company by their agent
in Japan is not clear, it seems probable that the at-
titude of the Japanese Patent Bureau in refusing to ac-
cept an application from the Company for the registra-
tion of a Trade Mark was based, not on the fact that
Hongkong is debarred from participation in any Trade
Mark privileges conferred by the Anglo-Japanese Treaty
(for as Sir E. Grey observes this Treaty makes no re-
ference to Trade Marks) but on the fact that in virtue
of Article 15 of that Treaty no Company registered in a
non-adhering
